1. Age Verification Requirements

Pre-1898 firearms, muzzleloaders, and antique-classified items require the buyer to provide proof of age (18+) before shipment.

Ammunition purchases require age verification consistent with federal and state law (18+ for rifle/shotgun ammo, 21+ for handgun ammo unless state law differs).

The buyer is responsible for submitting valid, legible identification upon request. **Orders will not ship until age verification is completed.**

2. Firearms Requiring Transfer to an FFL

Any firearm not classified as an antique under federal law must be shipped to a qualified FFL or C&R license holder, depending on eligibility.

The buyer is responsible for:

  • Selecting a receiving FFL
  • Ensuring the FFL is open, active, and willing to accept the transfer
  • Providing all necessary license information in a timely manner

We will only ship to the address listed on the receiving license. Failure to provide correct FFL information may result in delays or additional fees.

3. C&R License Requirements

For any item eligible for transfer to a Curio & Relic (03) FFL:

  • The buyer must provide a current copy of their C&R license.
  • A matching government-issued photo ID with the same address as the license is required.
  • If the addresses do not match, the item must be shipped to a standard FFL instead.

We reserve the right to decline C&R transfers at our discretion if documentation is incomplete or unclear.

4. Buyer Responsibilities

By placing an order, the buyer certifies that:

  • They are legally allowed to purchase and possess the items ordered.
  • They understand and comply with all federal, state, and local laws governing firearms, ammunition, and restricted items.
  • They will not request shipment to any jurisdiction where the item is prohibited.
  • They will communicate with their receiving FFL and ensure all transfer arrangements are made.

We are not responsible for: refusal of an FFL to accept a transfer; delays caused by incomplete or incorrect buyer information; or items returned due to regulatory issues or FFL refusal.

5. Compliance & Restricted Items

We reserve the right to cancel any order that appears unlawful or suspicious, request additional documentation to verify eligibility, and refuse shipment to jurisdictions with restrictive law.

The buyer is solely responsible for knowing their local laws. Items confiscated by authorities due to non-compliance will not be refunded.

6. Condition of Items

All items are sold as-is, with condition described to the best of our ability. Antique and surplus items may show wear consistent with age and use. The buyer is responsible for reviewing all photos and descriptions before purchase.

7. Limitation of Liability & Firing Safety Warning

Once an item is delivered to the receiving FFL or buyer (for antiques), our liability ends. We are not responsible for damage caused by improper handling, misuse, modification, or malfunctions resulting from age, ammunition choice, or wear.

CRITICAL SAFETY WARNING: Most firearms sold by Butler Brothers Military Arms are antiques or collectible items and are tested for functionality but are not certified, tested, or guaranteed to be safe to fire. These items are sold strictly as historical collectibles. If a buyer intends to fire any antique or surplus firearm, it is their responsibility to have the firearm inspected and cleared for use by a qualified, certified gunsmith prior to any discharge. Butler Brothers Military Arms assumes no liability for the safety, function, or performance of any firearm that is fired. All firearms are sold as-is, and the buyer accepts all risks associated with the handling, loading, or firing of any item purchased.

8. Order Cancellations

Before Shipment: Orders canceled before shipment are subject to a **15% restocking fee**. This fee covers payment-processor charges, administrative time, and removal of the item from active listings.

After Shipment: Once an item has shipped, the order cannot be canceled. Any return must follow the standard return policy guidelines.

9. Non-Communication, FFL Refusal & Failure to Pick Up

The following situations are treated as buyer-initiated cancellations and are subject to the **15% restocking fee, plus all shipping costs**:

  • The buyer fails to communicate or provide required FFL/C&R documentation after an order is placed.
  • The receiving FFL refuses delivery, is closed, or is unwilling to accept the transfer.
  • The buyer refuses to pick up the firearm from the FFL.
  • The buyer provides incorrect or invalid FFL information.
  • The buyer or FFL causes the item to be returned due to inaction or non-response.

In these cases, the buyer is responsible for all return shipping costs, the 15% restocking fee will be deducted from the refund, and original shipping charges remain completely non-refundable.

10. Sales Tax

Applicable state and local sales taxes will be collected on orders where required by law. Tax rates are determined by the shipping destination and current regional regulations.

11. Acceptance of Terms

By placing an order on this website, the buyer acknowledges and formally agrees to all Terms of Sale, Shipping Terms, License Requirements, and any other policies posted on this platform.
